Product Terms and Conditions

  1. Greystone 1590 CC (“the Promoter”, “we”, “our” or “us”) is a supplier of content (“content”) such as ringtones, pictures and information to consumers (the “consumer” or “you”) on their mobile phones. The content is able to be purchased by Vodacom, MTN, Cell C and 8ta(the “Network/s”) contract and prepaid subscribers in South Africa (the “services”).
  2. All content is delivered immediately to your mobile phone although sometimes there is a small delay due to the Networks.
  3. You must be 18 years or older to purchase content and you must have the bill payer’s permission to use these Services. If you are a parent and want to restrict these services please contact us or contact your Networks who will assist you with parental control or go to www.parentscorner.org.za.
  4. We try to make our Services compliant with the Consumer Protection Act 68 of 2008 (the “CPA”) and these Services are open to all South African residents, subject to the restrictions indicated in these Terms and Conditions (the “Terms”). Changes to circumstances (such as changes to the CPA) may mean that we need to change these Terms. If possible we will let you know well before we do this, but as we have so many Services this may not be possible. Please check these Terms from time to time to see if there are any changes. 
  5. Normal Network charges may apply when you send messages to us. Please remember that there are fees due for the content items you request (but not to enter the Competitions aside from the Network fees which are always below R1.50) and these fees can be found in our terms and conditions of service.

  7. Charges

  8. Vodacom and 8ta R1.67/20 Seconds – Premium Rated USSD Apply. MTN R1.67/content item or R3/60 seconds - premium rated USSD for Lucky Scratch Card and Cell C R1.67/content item - Standard USSD Rates Apply.
  9. Please note that there are charges that are not charged by us but by the Network so please refer to your Network for the details of these charges (which are in addition to the charges indicated above):
    • Standard USSD Rates (please refer also the actual service on your mobile phone) (Cell C) and (MTN - excluding Lucky Scratch Card).
    • Premium Rated USSD (Vodacom)(MTN - Lucky Scratch Card(8ta)
    • Network charges.
  10. All prices include VAT. Please note that errors on your part are billed so please be careful when sending an SMS to us.
  11. General Rules

  12. You can buy as much content as you want but please note that if you make a mistake when sending an SMS to us you will be billed.
  13. Lucky Quotes, Lucky Starz, Lucky 8 Ball, Lucky VIP and Lucky Scratch Card Services are not subscription services – in other words you only pay for the content you request. If you stop requesting content then you do not receive any content and you will no longer be entered into any competition.
  14. Free SMS’ and bundles do not apply.
  15. We will give you a Personal Identity Number (PIN) when you start using some of our Services which you agree to keep secret. Please keep this safe and tell as immediately if you lose the PIN or if you think someone else has access to it. If you do not tell us about this you will be responsible for the services consumed using that PIN number until the time that you informed us your PIN was lost/stolen/known by another person.
  16. We may suspend the services to repair, maintain and/or upgrade our systems. In such event, we will aim at keeping the interruption as short as possible and cause as little inconvenience to you as possible.
  17. We reserve the right to modify or discontinue, temporarily or permanently, individual services provided by us. If a service is to be permanently discontinued by us, we will notify you as early as we can of this fact and if you have already paid for any content item we will refund your purchase.
  18. If the content provided to you cannot be read or does not function as it should (for example a ringtone that does not play) we will resend the content to you at no further cost to you, provided that you let us know within 10 business days of receiving the content.
  1. These Rules are governed by the laws of South Africa.
  2. If we have a reasonable suspicion that you are engaged in any fraudulent act or breaching these Terms we can suspend your access to the Services. If we find that you have breached these Terms and/or committed a fraudulent act you will be disqualified from using the Services and we may report you to the South African Police Services for criminal prosecution if applicable. We will inform you of your suspension or your disqualification by SMS or by telephone.
  3. We must collect and use personal information about you (“Personal Data”) to run the Services. Personal Data which you provide will be used by us and our affiliates and representatives for the purposes of this Competition and for any extra Services which you have requested. We may request that you allow us to use your name and/or image in marketing material but if we do this you will be always able to refuse to allow us to do so.
  4. For any enquiry including a copy of past Terms and Conditions as well as a record of your transactions please call Greystone 1590 CC Customer Care on 0861 11 11 06 during normal working hours (Mon to Fri 9am - 5pm) or send an email to [email protected]. Please note we will only give out information regarding your transactions if we are sure that you are the account holder or that you have the account holder’s permission to do so. Please note that we do not respond to complaints by SMS.
  5. Should there be an error with our providing the Services where we need to refund you then we will do so by providing you with air-time on your Network in the form of an airtime voucher which will be sent to you electronically.
  6. If you want to stop using our Service/s or receiving any marketing messages please send the message “out” by SMS to the telephone number (short code) that sent you the message. If you continue to receive messages then please contact Customer Care by email or telephone so that we can assist you.
  7. Once you have signed up to our Services you agree that we can send you a message at any time in response to your request for content.  We will not send you marketing messages on Sundays, public holidays, on Saturdays before 09h00 and after 13h00, or on all other days between 20h00 and 08h00 the following day.
  8. As this service is rendered to you immediately and electronically there is no cooling-off period applicable to the transaction (please refer to s42(2)(d) of the ECT Act).
